This matter comes before this Court upon a petition for a writ of habeas corpus under 28 U.S.C. § 2254 (1976). Petitioner is seeking collateral review of his jury trial which resulted in a conviction for deviate sexual assault and unlawful restraint. The conviction was subsequently affirmed by the Illinois Appellate Court. People v. Beasley, 106 Ill.App.
