COFFIN, Circuit Judge.

This case arises out of a fatal car accident. The driver of the car, Devon Bates, was killed. The two passengers in the car, Janet Nussman and Sandra Croes, were seriously injured. Nussman . and Croes brought this suit for damages against Bates’s employer, the United States government.
