This is a summary judgment case.

Redstone Federal Credit Union, the plaintiff, sued Mr. Neal upon his credit card account and, under count two, on a promissory note executed by the defendant to the plaintiff. The defendant promptly filed his answer which simply denied the material allegations of the plaintiff’s complaint.
