This case involves a breach of contract to devise 40 acres of land. It was tried to the court and review is on that basis.

Plaintiff/appellant Sylvia Bailey (plaintiff) and her sister Shirley Bailey Cronin, one of the respondents in this case, were involved in a series of land transactions between 1958 and 1979 with their now deceased parents, Chester and Hazel Bailey.
