In this appeal, the defendants, Wolfeboro Railroad Co., Inc. and Wolfeboro Railroad Associates, challenge the judgment of $28,764.74 entered by the Superior Court (Wyman, J.) in favor of the plaintiff, Everett Albee. We affirm in part and reverse in part.

The defendants own and operate an excursion railroad between Wolfeboro and Wakefield.
