This suit was brought by the debtor, Buckley & Associates, Inc., while it was still operating under a confirmed chapter 11 plan of reorganization. When the case was converted to a chapter 7 liquidation, the bankruptcy trustee was substituted for the debtor as the plaintiff in this proceeding.
