This is an appeal by the State of Alabama from the dismissal of a child neglect case in the Juvenile Court of Montgomery County. The Montgomery County grand jury, on November 5, 1985, indicted appellant Cynthia Wheeler for child neglect in violation of § 12-15-3, Code of Alabama 1975.
