This is an appeal from a judgment of conviction and sentence on a jury trial on an indictment that charged in pertinent part that “on, to-wit: December 31, 1977, Richard Clark did unlawfully possess marihuana, one of the controlled substances set out in the Alabama Uniform Controlled Substances Act.
