INTRODUCTION

Plaintiff United States of America (“the United States”) has brought the instant action against Defendant Richard Diamond (“Diamond”), alleging that defendant submitted false Medicare claims. Plaintiff moves for partial summary judgment on its claim under the False Claims Act, 31 U.S.C. § 3729,

et seq.

(“the FCA”).
