MEMORANDUM OPINION AND ORDER

Plaintiff Andrew Johnson brought this action seeking to recover for injuries sustained when a helium tank exploded in the course of his employment with certain divisions of the BOC Group, Inc. (“BOC”). Plaintiff seeks to recover from the owner of the helium tank, Jack B. Kelley, Inc.
