MEMORANDUM AND ORDER

COHN, District Judge.

This is an action for judicial review pursuant to 42 U.S.C. § 405(g) of a final decision of defendant Secretary of Health and Human Services discontinuing plaintiffs Social Security disability insurance benefits. Because the complaint was not timely filed, the Secretary filed a motion to dismiss the action for lack of federal subject matter jurisdiction.
