MEMORANDUM AND ORDER CONCERNING PARTIAL SETTLEMENT

These partially consolidated cases are presently before the Court for approval of a Partial Consent Decree (the “Proposed Decree”) between the plaintiffs, the United States of America and the Commonwealth of Massachusetts (hereinafter, the “sovereigns”), and the defendant AYX Corporation (“AVX”).
