TYSON, Judge.

I.Q. Kirby was indicted on three counts of second degree kidnapping in violation of § 13A-6-44, Code of Alabama 1975, and two counts of first degree robbery in violation of § 13A-8-41, Code of Alabama 1975. The appellant was convicted of one count of first degree robbery and three counts of second degree kidnapping, all as charged in the indictment.
