OPINION

WOODARD, Justice.

This is an appeal from a summary judgment in favor of the Defendant, Mr. Fuentes. We reverse.

The parties contracted for Fuentes’ purchase of certain bowling, restaurant and bar equipment. On the execution of the agreement, $20,000.00 was paid, $30,000.00 was to be paid on or before March 1, 1986 and $135,000.
