This is an appeal from a summary judgment in favor of the defendant in a malicious prosecution action. On or about November 5, 1985, Ted W. Stacks was in the process of moving out of a house located in Mobile that he was renting from Jacque Pate, Jr. As Stacks was packing his belongings into his automobile, Pate arrived.
