Defendants move to dismiss the indictment on double jeopardy and due process grounds. Fed.R.Crim.P. 12(b)(2).

Defendant Robert Lee Jordan is charged with conspiracy to distribute cocaine. 21 U.S.C. § 846. His motion alleges that he was convicted and sentenced for the same underlying conduct in two cases in the Philadelphia Court of Common Pleas.
