On January 13, 1988, the grand jury returned a two-count indictment against John

Sherman, Ira Lustig, Nathan Williams and appellant Larry Sims. Count One charged each defendant with conspiracy to defraud a bank in violation of 18 U.S.C. §§ 2, 656, 1344 and 2113(b).
