Defendant, a physician licensed to practice medicine in New *464York State, stands before the court charged with the crime of menacing (Penal Law § 120.15). It is alleged that on May 3, 1989 at 5:00 p.m. at 600 6th Avenue in New York County, the defendant pointed a gun at one Mario Vincenzino and said "don’t move” and "next time I’ll fill you full of holes.
