This litigation arose out of a contract between the United States Army Corps of Engineers (“Corps”) and Servidone Construction Corporation (“Servidone”), for completion of an earthen dam near Dallas, Texas. The action was brought under the Contract Disputes Act, 41 U.S.C. §§ 601-613 (1982).
