Supreme Court of Alabama March 15, 1991, 89-1370 (Tyler v. City of Enterprise)

This case is before us for the second time. In the first appeal, from a summary judgment in favor of the defendants (the City of Enterprise and one of its police officers), we reversed the judgment and *Page 877 remanded the case because discovery had not been completed and the summary judgment was, at the least, premature.
