BEAM, Circuit Judge.

Steven Satter appeals the denial of his petition for a writ of habeas corpus under 28 U.S.C. § 2254. In 1974, he was convicted of two counts of involuntary manslaughter. His convictions were affirmed on direct appeal, but were vacated by the South Dakota Supreme Court in two actions for post-conviction relief. Satter is now in custody, awaiting retrial.
