This case is before the court on the plaintiffs motion for reconsideration and to alter or amend the court’s May 26, 1994, Memorandum and Order, pursuant to Fed.R.Civ.P. 59(e) and D.Kan. Rule 206 (Doe. 232). In that ruling, the court dismissed Count I of plaintiffs complaint against defendant Resolution Trust Corporation (“RTC”).
