This is a companion case to State v. Trinh, 124 Or App 555, 863 P2d 532 (1993), which involved defendant’s brother, Nghia Van Trinh. The underlying facts of the crimes were summarized in that opinion. Defendant shot and killed the victim. A jury convicted him of murder with a firearm, ORS 163.115(1)(a); felony murder with a firearm, ORS 163.
