Robert and Annie Simmons filed suit against the Kroger Company, Lawrence Elder, the store manager, and Gregory Walker, a store security guard, jointly and severally for damages on claims of false imprisonment, false arrest, battery, tortious misconduct and loss of consortium arising from an incident which occurred on December 24, 1991, at the Kroger store located on Cascade Road
