Plaintiff, Allstate Insurance Company (“Allstate”), has filed this declaratory judgment action pursuant to 10

Del.C.

§ 6501 seeking a determination of whether the defendant, William Gillaspie (“Gillaspie”), is entitled to uninsured/underinsured motorist (“UM”) coverage benefits. Allstate and Gil-laspie have filed Cross Motions for Summary Judgment.
