(“Harmony”) brought this action to enjoin the State of Delaware Department of Transportation (“DelDOT” or the “Department”) from awarding and entering into a public works contract with Daisy Construction Company (“Daisy”) on Public Contract No. 95-061-03 (“Contract 08”). On March 28,1995, Harmony submitted a bid on Contract 03 of $1,104,-049.
