OPINION

KENNEDY, Justice.

Linda Benavides appeals from an adverse judgment in her suit against American Chrome & Chemicals, Inc (“ACC”). We reverse and remand for a new trial.

Because we reverse on a procedural point, we will discuss the underlying facts only briefly. Benavides alleged damages arising from gross negligence in connection with her husband’s death.
