We have granted the State’s petition' for further review pursuant to Neb. Rev. Stat. § 24-1107 (Cum. Supp. 1994). The State appeals the Court of Appeals’ decision reversing and remanding for new trial the conviction by jury of Gregory T. Neujahr for knowingly or intentionally possessing a controlled substance in violation of Neb. Rev. Stat. § 28-416(3) (Cum. Supp. 1992).
