The Department of Transportation, Bureau of Driver Licensing (DOT) appeals from an order of the Court of Common Pleas of Lawrence County (trial court) which rescinded the one-year suspension of Joseph Fren-gel’s (Frengel) operating privilege which was imposed as a result of his failure to submit to a chemical test pursuant to Section 1547(b)(1) of the Vehicle Code (Code), 75 Pa.C.
