Following trial of the above-captioned case, the jury returned a verdict for plaintiff. Defendant William R. Whalen has made a motion for judgment as a matter of law, pursuant to Fed.R.Civ.P. 50(b), or for a new trial, pursuant to Fed.R.Civ.P. 59. In the alternative, he seeks a remittitur of the punitive damage award against him.
