FINDINGS OF FACT AND CONCLUSIONS OF LAW

PRESEA, District Judge:

Plaintiffs Pedro and Rose Escalera (the “Escaleras”), tenants in New York City public housing, filed a class action in 1967 under 28 U.S.C. §§ 2201, 2202 and 42 U.S.C. § 1983 against defendant New York City Housing Authority (the “Housing Authority”) and certain of its officers.
