The Court has before it the complaint of MBNA America (“Plaintiff’) against Mark Edward Chrusz (“Defendant”) seeking that a certain access check in the amount of $16,000 used by the Defendant be excepted

from

discharge pursuant to 11 U.S.C. §§ 523(a)(2)(C) (Count II) and 523(a)(14) (Count IV).
