Plaintiff-appellant, Frank McCubbin, was injured when the rung of a wooden ladder upon which he was standing broke. As a result of the break, McCubbin fell fifteen feet and sustained various injuries. The ladder had affixed to it a label from the Dayton Safety Ladder Company.
