MEMORANDUM OPINION

In 1989, Appellee Leon Shackelford was fired from his job with Appellant Oklahoma Military Department [OMD]. Appellee immediately challenged his termination by appeal to the Merit Protection Commission [Commission], and soon after filed a motion to recover his attorney fees, even though the Commission had not yet decided his appeal.
