This is a diversity of citizenship case involving an alleged wrongful payment of a cheek by Defendant Bank of America. The Court referred Defendant’s motion for transfer pursuant to 28 U.S.C. § 1404, partial summary judgment, and/or to dismiss under Federal Rule of Civil Procedure 12(b)(1) to Magistrate Judge Andrew J. Peck.
