This action arises under the Resource Conservation and Recovery Act’s (RCRA’s) citizen suit provision, 42 U.S.C. § 6972, and the Oregon Superfund statutes. Plaintiff Express Car Wash filed a citizen suit against defendants Chevron U.S.A.
