James Harrell Hammonds appeals from a judgment based on a jury verdict in favor of George Turnipseed. This case is before this court pursuant to § 12-2-7(6), Ala. Code 1975. In December 1995 Turnipseed, a licensed real estate broker, sued Hammonds, seeking *Page 40 damages for the breach of an express/implied contract to pay a 10% real estate sales commission.
