The plaintiff, Lee Cihon, filed a two-count complaint against the defendant Cargill, Incorporated (Cargill), alleging common law negligence and violations of the Structural Work Act (740 ILCS 150/ 0.01 et seq. (West 1994)). A jury returned a verdict in favor of Cihon and against Cargill on both counts and assessed damages totaling $780,000.
