Ap*755peal from a judgment of the Supreme Court (Teresi, J.), rendered November 7, 1994 in Albany County, upon a verdict convicting defendant of the crimes of rape in the first degree, robbery in the first degree and robbery in the second degree.

In October 1993, George Giametta and a woman (hereinafter the victim) moved into a home in the Town of Colonie, Albany County.
