Wade Vaughn appeals from a summary judgment entered in favor of DCH Health Care Authority. This case is before this court pursuant to § 12-2-7(6), Ala.Code 1975.

Our review of the record reveals the following pertinent facts: Vaughn sustained an injury to his back in the winter of 1994. Thereafter, Vaughn sought medical treatment from Dr. H.
