ALAIMO, District Judge.

Plaintiff, Alfonso Martinez, Jr. (“Martinez”), brings this action pursuant to 42 U.S.C. § 1988, against Defendant, Kevin Mathis (“Mathis”), in his individual capacity. Martinez alleges that he was physically assaulted while an inmate at the Jeff Davis County Jail (the “Jail”) because Mathis, a jailer, encouraged two other inmates to beat him.
