On April 21, 1997, the plaintiff, Jerome Brown, filed this civil action against ABF Freight System, Inc. (“ABF”), alleging a violation of the Americans with Disabilities Act (“ADA”), 42 U.S.C. §§ 12101

et seq.

and the Virginians with Disabilities Act (‘VDA”), Va. Code §§ 51.5-40

et seq.
