YEAKEL, Chief Justice.

We withdraw our original opinion and judgment filed July 16, 1998, and substitute the following.

A jury found appellant Milton Elliott guilty of two counts of felony tampering with a governmental record. Tex. Penal Code Ann. § 37.10(a)(2) (West 1994).

The trial court assessed punishment at imprisonment for five years and a $5,000 fine.
