This case came before the Supreme Court on May 5, 1998, pursuant to an order directing both parties to show cause why the issues raised by this appeal should not be summarily decided. The defendant, Lee’s Wharf Marina Association (association), has appealed the granting of a partial summary judgment on its counterclaim against the plaintiff, Greensleeves, Inc. (Greensleeves).
