BOOCHEVER, Circuit Judge:

Appellant Isadore Sylve was arrested within a federal enclave in the State of Washington for driving under the influence of alcohol. Sylve moved for “deferred prosecution,” a rehabilitation program available under Washington law which resembles pre-conviction probation.
