MOORE, Justice:

The State appeals an order admitting respondent Tootle to a pretrial intervention program (PTI). We reverse.

FACTS

Tootle is an attorney admitted to practice in this State. He failed to file State income tax returns for eight tax years (1985-88 and 1990-93) and was indicted for violating S.C.Code Ann. § 12-54-40(b)(6)(c) (Supp.1997).
