In this case, the Court must decide whether Va. Code § 38.2-2206 offers Plaintiff an opportunity to sue the Defendants and collect a judgment from the Defendants’ uninsured motorist (“UM”) carriers despite the provisions of the Workers’ Compensation Act (“Act”) set out in Va. Code § 65.2-300 et seq.
