WOLLHEIM, J.

The state appeals a pretrial order granting defendant’s motion to suppress evidence from field sobriety tests. The order was based on the trial court’s finding that in administering the tests, the police officer unlawfully expanded the scope of his investigation in violation of ORS 810.410 (1995).
