I. FACTUAL AND PROCEDURAL BACKGROUND

Lake Geneva Sugar Shack, Inc. (“Sugar Shack”) is a Wisconsin corporation that operates the Sugar Shack nightclub in Lake Geneva, Wisconsin. Dana Montana was the sole shareholder and principal officer of the corporation.

Defendant General Star Indemnity Co. (“Genstar”) is a Connecticut based insurance company.
