DECISION and ORDER GRANTING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT and DISMISSING ADVERSARY PROCEEDING

This adversary proceeding arises in defendant’s Chapter 7 bankruptcy case. Plaintiff initiated the present adversary by filing a complaint whereby it sought to have a debt owing by defendant declared nondischargeable, pursuant to 11 U.S.C.
